The My DTO platform is offered to you by means of a website on the Internet, under the form of a Software-as-a-Service, by JFD-SOFT, a company under Belgian law with its registered office at; 4960 Malmedy, La coulée 16, registered at Banque-Carrefour des Entreprises under the number 0779.552.178 (e-mail: jfdsoft@gmail.com), and exclusively distributed by GV2 SKY SOLUTIONS, registered at Banque-Carrefour des Entreprises under the number 1026.307.906 (e-mail: contact@gv2.eu).

The use of My DTO is subject to compliance with the conditions below. By using My DTO, the user accepts these conditions. The exemptions to these terms of use are only binding if they have been accepted in writing by JFD-SOFT. 

Read the following paragraphs carefully.

1.  Acceptance 

If the User does not agree with the Terms of Service, he/she cannot use the Online Service and must immediatly immediately stop using My DTO. 

2.  Object 

My DTO is software on a website via the Internet as an online service. My DTO is not sold, but licensed; in license to flight schools and/or aerodromes.

My DTO automates optimizes communication and interaction between flight schools and/or aerodromes and their respective customers, both being  after “user” or “users”).

3.  Technical Requirements 

JFD-SOFT makes every effort to make its application compatible with every modern Internet browser. It is recommended to use a compatible Internet browser to work easily with the application.  ;

4.  Right to Use 

Subject to the acceptance of the conditions of use below,  JFD-SOFT  grants a temporary, non-exclusive and non-transferable right of use to the user. This right is limited; internal needs of the user’s organization or business. only online, exclusively for the benefit of the user. It is forbidden for the user to transfer the right of use to a third party, or to grant (directly or indirectly) to third party access to online services and the My DTO platform without the prior written authorization of JFD-SOFT. By “ third party» means any entity; legal different from the user. 

It is forbidden to use My DTO for acts contrary to legislation and to Belgian regulations or any other applicable regulations or legislation. In particular, it is prohibited to use My DTO for the storage of files in violation of the applicable legislation in terms of copyright, data protection law or intellectual right, or grant to; third parties access to stored files. 

Users are prohibited from using My DTO in any way that may harm My DTO,  its suppliers and/or to third parties, or to interfere with its availability. 

The user’s’ do not use My DTO  illegal purposes or in connection with conduct that would otherwise be wrongful, illegal, misleading or harmful to JFD-SOFT, ses suppliers or third parties. 

The User may not deal with any content (i) that is in any way illegal, provocative, defamatory, irregular, threatening or harmful, or that is otherwise objectionable; (ii) that it is not authorized; to deal under any law or contractual or fiduciary relationship; (iii) that constitutes an infringement of the rights of a third party, including, without limitation, the proprietary rights; intellectual property and business secrecy. 

The right to use does not confer on the user any right to (i) free specific adaptations or supplements of My DTO, (ii) a free substantial revision of My DTO and (iii) free adaptations imposed by the legislator, including JFD-SOFT  ;could not have foreseen the extent or the difficulty of of achievement.  

User acknowledges that JFD-SOFT and its subcontractors are continually improving and adapting My DTO. the latest edited version of the online service. All new updated version. update of the online service supersedes the previous version as a modified version and is therefore subject to all the rights and obligations provided for in this contract. The service may be temporarily unavailable to the user during updates. day. 

If it considers that the operation of the computer systems or the network of JFD-SOFT or third parties and/or the service via the Internet is disrupted, damaged, or exposed to any other risk, JFD-SOFT is authorized to take all the measures it deems reasonably necessary to counter or prevent this risk. 

JFD-SOFT reserves the right to at any time the right to deprive a user in whole or in part of his access to My DTO unilaterally and without prior notification, in particular in the event of violation of these conditions.

5.  Access and availability 

The user has access to My DTO via an My DTO account. An My DTO account consists of an e-mail address, a password and a profile intended for the user. to provide a more personalized user experience. The user is in no way authorized to to put his account at; the disposal of third parties without the prior written authorization of JFD-SOFT. 

The terms of use remain in effect as long as the user has access to My DTO via his My DTO account. 

JFD-SOFT's ambition is to offer the availability of maximum and permanent with normal use. 

JFD-SOFT makes every effort to guarantee, as far as possible, access to My DTO 7 days a week and 24 hours a day, without making the slightest guarantee in this regard. . However, this access may be interrupted, in particular in the event of maintenance and updating. day, in case of failure, error, bug and for any other technical reason that.  

The user himself acquires the hardware and software necessary to have access to My DTO. The user is solely responsible for the choice and proper functioning of the equipment. riel (hardware and software) as well as the conclusion of a contract with an Internet provider in accordance with the specifications communicated by JFD-SOFT.

The user is responsible for the proper functioning of his computer system (hardware, operating system, configuration, Internet connection, required software, etc.) and for his access to the Internet. JFD-SOFT is’not responsible for the telecommunications connections to its infrastructure, including the telecommunications connections of the user. My DTO  bound to the use of other software and applications (such as Internet browser, Windows, …), JFD-SOFT is’not responsible for the use of such software or applications. 

6.  Support and training 

Linked support to the use of My DTO is primarily provided by the flight school/aerodrome that has affiliated it. and activated the user on the My DTO platform.

JFD-SOFT will itself provide a reasonable level of support for the My DTO software. Technical problems, suggestions or remarks concerning the site or the use of the application must be transmitted by email or telephone. 

JFD-SOFT does not guarantee the processing  of all feedback. However, any feedback that contributes to an improvement in the operation of the application will be greatly appreciated; and taken into account.

JFD-SOFT can provide training related to; the use of My DTO  the request and for a price at; suit. 

If the user does not have an adequate knowledge of My DTO, JFD-SOFT can require that he follow the My DTO training sessions in order to bring this knowledge to a higher level. a sufficient level so that it no longer has to solicit support in a disproportionate way. JFD-SOFT  will judge the reasonableness of this request based on its history of support. If the user’does not respond to this request, JFD-SOFT is empowered to suspend the support until what the user has worn his knowledge to; a sufficient level, without the user being entitled to any compensation. 

7.  Property intellectual

JFD-SOFT guarantees that it has all the necessary rights concerning My DTO, including all rights relating to; the underlying computer programming. 

This contract does not imply any transfer of property rights; intellectual property to the user. Property rights intellectual continue to fully belong to JFD-SOFT and any subcontractors. 

Property Rights pre-existing intellectual property on the information, documents, data and metadata processed by the user via My DTO remain belong to; the user to the extent that & ugrave; they do not conflict with proprietary rights; intellectual property of JFD-SOFT and/or its subcontractors. JFD-SOFT reçis a license on these rights insofar as it is necessary for its right of use.

The user will immediately inform JFD-SOFT of any infringement concerning My DTO or any other violation of a right of ownership. intellectual property of JFD-SOFT which he will havet knowledge.  

For the purposes of this article, property right means: intellectual property: all intellectual property rights; intellectual property, including but not limited to patent rights, copyrights, know-how rights, related rights, trademark rights, design rights, rights to domain names, rights to databases, rights to software and computer programs and other sui generis rights.  

8.  Liability 

User’understands that My DTO is an online application and that the software will primarily run from the hardware and infrastructure deployed by the user. JFD-SOFT cannot be To be held responsible for any failure or failure of My DTO attributable to (i) network or communication problems between the user and JFD-SOFT, (ii) a failure or failure of the software or hardware that does not come from JFD-SOFT, ( iii) changes or modifications made to the My DTO without the authorization of JFD-SOFT (iv) the use by the user of inappropriate hardware or software, ;(v) user’s handling error, (vi) lack of security of the user’s system or (vii) wrongful use or fraudulent use of the account by the user or a third party.

JFD-SOFT will also not be held responsible for links to or services provided by third-party websites accessible to them. from My DTO or any other connection or interaction with third party functionalities.  When the user makes use of such a direct or indirect connection between the My DTO Application and a third party application, platform and/or network (for example Peppol for sending or receiving invoices), the user accepts that JFD -SOFT has an obligation of means to; in this respect and does not guarantee any results with regard to such a connection. to the services provided through such a link. 

JFD-SOFT disclaims all liability vis-à-vis the user in the event of loss of profits or turnover, or indirect or collateral damage, whatever the cause, that JFD-SOFT  has been informed or not of the possibility of of such loss or damage.   total of JFD-SOFT is limited in any case to; compensation for direct financial damage and is capped at the compensation received by JFD-SOFT for the service(s) concerned (excluding VAT and other levies imposed by the authorities) during the three (3) months immediately preceding the month in which the event occurred. the origin of the damage. 

User will take all necessary measures that can reasonably be expected to limit damages.

Restrictions of liability above do not apply in the event of a claim for compensation for as a result of death or bodily injury, or where there is question of willful intent or gross negligence on the part of the party involved; the origin of the damage, including its employees or the third parties it has called upon. 

The user has access to his account data via My DTO after entering a protected identifier; by a password. Confidentiality username and password is the responsibility of the user. exclusive to the user. The user will take all necessary precautions to avoid any misuse of My DTO by himself or third parties.  

JFD-SOFT  will not be questioned nor will it be held responsible. otherwise liable for a delay or failure in performance of the contract if the cause of the delay or failure inmatter is unforeseeable and beyond its reasonable control, including but not limited to the following circumstances: earthquake, flood, fire, epidemic, pandemic ,  public order, terrorist acts, failure or delay in transport or communication.  

By force majeure on the part of JFD-SOFT, we also mean illness of the staff, lack of staff, strike, shortcomings attributable or not to a fault. subcontractors, power failure or interruption, interruption or disruption of network connections on the part of JFD-SOFT as well as any damage caused; by a virus or other forms of computer contamination. 

9.  Personal data processing and cookies

The user protects JFD-SOFT from any action or request for compensation or injunction brought by a third party for violation of his rights to the data or documents or violation of his rights. the law applicable to the protection of privacy in the context of the granting of the license to use My DTO. The user will assist JFD-SOFT in its defense and will indemnify it for all costs incurred (including attorneys’ fees and procedural indemnities) and sums that may have been incurred; paid by JFD-SOFT  third parties.  

The User acknowledges that sending personal data over the Internet is never without risk. The User acknowledges and therefore accepts that he/she will never be able to request repair to JFD-SOFT any damage it may suffer as a result of irregular access to personal data by third parties who have not obtained authorization to this effect.

10.  Privacy 

JFD-SOFT recognizes the confidential nature of the information transmitted by the user within the framework of the service as well as the data that the user transmits and uses via My DTO (“Information confidential”). JFD-SOFT”is’committed to; not modify the Confidential Information, and only use them to no other end than the finality; and the subject matter of this contract. Confidential Information does not include information (i) which is or becomes generally public, without having been made public by JFD-SOFT ; (ii) of which JFD-SOFT already had knowledge before their publication; (iii) who have been independently developed by JFD-SOFT. 

JFD-SOFT and the user will respect strict confidentiality. concerning information relating to; their mutual organization, the contents of the files, the operation of the software, etc.  the provision to third parties of the data and data and information carriers which are at their disposal; their disposal and will not bring them to knowledge of their staff only to the extent that & ugrave; this is necessary to carrying out the agreed activities. 

JFD-SOFT is authorized to publish information about the services and work performed by him, and to reuse its methods, etc.

11.  Hyperlinks and links to third-party websites

Websites outside the domains and subdomains of My DTO, and in particular the places to which the user is referred; by means of links and hyperlinks, including by « deep link» (deeplinking), remain the sole responsibility; of the owners of these websites and are exclusively the responsibility of the owners of these websites. liability of the owners of these websites.

It is forbidden to establish links to My DTO without the prior authorization of JFD-SOFT.  

12.  Applicable law and jurisdiction 

Any dispute related to to or arising from (the use of) My DTO or from the application and interpretation of these conditions is governed by Belgian law, the courts of the district where is established the registered office of JFD-SOFT with exclusive jurisdiction.
